1. Agreement

These Terms of Use govern access to the Dely Cart platform (website and mobile application) operated by Foodistic Marketing Services Private Limited, a company incorporated under the Companies Act, 2013, with registered office at Vimti Laxirampur, Heerapatti, Sadr, Azamgarh, Uttar Pradesh 276001. By registering or using the platform, you agree to these Terms and related policies (including the Privacy Policy).

2. B2B nature of services

Dely Cart is a B2B digital marketplace for FMCG and related products. Users may browse, order, and manage business purchases as permitted by the platform. Features for sellers or other roles are subject to separate rules we may publish.

3. Account and conduct

You must provide accurate business and contact information, keep credentials secure, and use the platform only for lawful purposes. You must not misuse the service, interfere with other users, or attempt unauthorised access.

4. Orders, payments, and fulfilment

Orders, prices, delivery, returns, refunds, cancellations, and undelivered shipments are subject to the policies and workflows stated in the app and in the full Terms. Payment methods and credit terms may be configured as offered on the platform.

5. Intellectual property

Platform content, branding, and software are protected by applicable laws. You receive a limited licence to use the app for legitimate business use in line with these Terms.

6. Limitation of liability

To the extent permitted by applicable law, our liability is limited as set out in the full Terms. The platform is provided on an “as available” basis.

7. Governing law

These Terms are governed by the laws of India. Courts at appropriate jurisdiction in India shall have exclusive jurisdiction, subject to mandatory provisions of law.
